Requesting A Record

  • Requests for records must be submitted in writing.
  • Phone call requests do not fall under the requirements of the Public Information Act.
  • To request records, please complete the Records Request Form with as much information as you have available to you regarding record requested

  • If the information provided in the request is not clear or additional information is needed in order to locate the records requested, a written request for clarification via certified mail will be sent to the requestor.
  • If the requestor does not respond in writing to the letter for clarification within sixty-one (61) days, the request for records will be considered withdrawn and a new request for records would need to be submitted by the requestor.
  • **Note: Governmental agencies, legal representatives, etc. please submit requests on letterhead to avoid delay in processing your request.**
  • These requests are answered in the order in which they are received and may take up to ten (10) business days to be completed.
  • If the information requested requires a ruling from the Attorney General’s Office because it falls under one of the exceptions of the Public Information Act (Tex Gov’t Code, § 552.301), the request may take an additional forty-five (45) business days to be completed (Tex Gov’t Code, § 552.306).
  • **Note: In the event that the Attorney General’s Office determines that the information requested is protected under one of the exceptions to the Public Information Act, our agency will not legally be obligated to release the information requested.**

The Public Information Act (Tex Gov’t Codes, § 552.261-552.275) allows our agency to recover costs related to reproducing public information. Your request may be subject to charges assessed for reproducing these records, labor, overhead (which is calculated as a percentage of the total labor), and materials. In the event that charges are assessed for your request, you will receive a written cost estimate outlining these charges and information regarding payment to our agency.
